Workplace relations update | 10 February, 2023

ACCI’s Workplace Policy Committee is being convened today via Zoom for members to provide input on what constitutes genuine agreement for the development of a new set of Fair Work Commission principles under the recently amended Fair Work Act arrangements for the approval of agreements. The Minister for Employment and Workplace Relations, Tony Burke has outlined a two stage legislative agenda for 2023: 

  • An amending bill in the first half of 2023 on a handful of what the government views as less controversial matters, likely including a new National Employment Standard (NES) right to superannuation.  
  • A second, larger bill in the second half of the year to implement the remaining elements of the Labor’s 2021 Secure Australian Jobs Plan policy, including changing the definition of casual employment, same job same pay requirements for labour hire, plans for new regulation of employment like working relationships, and criminalising wage theft. Consultations commence on these matters very shortly, and ACCI approaches them with the benefit of recent member input through the Workplace Policy Committee at its 2 February meeting. ACCI is rolling out a series of guides for our members and their employer members, on the key changes under the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022. The first of these guides, on the non-bargaining amendments has been circulated to members for comment, and members are encouraged to provide any further input by COB 10 February 2023, after which a final version of the guide will be provided. Further guides are being prepared on bargaining, and on the various equity and anti-discrimination changes in both this amending act and other recent legislation. [Jess Tinsley / Simon Farrow
