Government Consultation on Workplace Relations Matters (First Half of 2023)
The Minister for Employment and Workplace Relations, Tony Burke, has announced that there will be at least two tranches of legislation on workplace relations matters introduced into the Federal Parliament in 2023. The Department of Employment and Workplace Relations has commenced consultation on the first tranche of legislation, including changes impacting superannuation, unpaid parental leave, employer deductions and the Coal Long Service Leave Scheme.

ACCI convened a meeting with members on February 17 to discuss proposed positions, which were then incorporated into our submissions to the Department.

Statement of Principles on Genuine Agreement
The Fair Work Commission is consulting interested parties in the development of a Statement of Principles which will assist them in determining whether a proposed enterprise agreement has been “genuinely agreed to”.

ACCI convened a meeting with members on February 10 to discuss these matters. ACCI has begun consultation with the Fair Work Commission, including with an initial meeting with President Hatcher and Deputy Presidents Asbury and Masson on February 13.

ACCI has been invited to meet senior members again after the Fair Work Commission releases their draft Statement of Principles for feedback (expected sometime during the week commencing February 27).

Annual Wage Review 2022-23
The first submission in the Annual Wage Review 2022-23, which relates to the treatment of employees of recently privatised state government assets, is due to be lodged by ACCI on February 17.

ACCI is also preparing its initial submission to the substantive review. ACCI will soon convene a meeting with members to finalise the network’s position on the minimum wage rate to apply from July 1.

Member Guides on Changes to Fair Work Act
ACCI has circulated a draft of a guide to some of the changes to the Fair Work Act following the passage of the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 last November. ACCI will shortly publish the final version of this guide for members.

ACCI has well advanced a second guide relating to changes to multi-employer and enterprise bargaining under the Fair Work Act. A draft will be circulated to committee members for feedback shortly.
