Right to Disconnect 

ACCI submitted its reply to the Fair Work Commission’s process to vary modern awards to include the right to disconnect this week, which is here

The submission disputed union claims and reiterated calls for the new modern award term only to provide the rights guaranteed under the legislation.  

ACCI does not accept that new obligations on employers or new employee rights are appropriate. ACCI will attend a consultation hearing before a Full Bench in Melbourne on 19 June to discuss the submission and those of the unions. 

The commission will publish a draft term for comment on 15 July and the final determination on 23 August. 

 

DEWR Consultations on Regulated Workers 

The Department of Employment and Workplace Relations has released discussion papers on the Digital Labour Platform Deactivation Code and the Road Transport Industry Termination Code, which is here.   

The two codes stem from the Closing Loopholes Bill changes and accompany the new regulated work regime for road transport contractors and employee-like workers. They will help determine whether deactivation from a digital labour platform or termination of a contract was fair. 

The department is seeking submissions from interested parties by 11 pm AEST on 27 June. The process is confidential, and submissions will not be published. ACCI will be making submissions on both discussion papers. Anyone interested in contributing should contact the Workplace Relations Team.
