Right to Disconnect 

The President of the Fair Work Commission, Justice Adam Hatcher, has published a statement and the draft modern award term for the right to disconnect, accessible here. 

The FWC has adopted a light-touch approach, consistent with ACCI’s recommendations. However, the commission has not delivered on union calls for a prescriptive term imposing additional obligations and rights that are not required under the legislation itself.  

The commission has invited interested parties to file submissions relating to the model term by 12pm on 1 August. ACCI will be filing a submission addressing the draft term. The Workplace Relations Team is interested in feedback from members, please provide any comments by 25 July.

 Meeting of the Expert Advisory Group on Modern Slavery 

 The Modern Slavery Expert Advisory Group met this week. The government established the group to provide expert advice on the operation of the Modern Slavery Act 2018

 ACCI director, workplace relations, Jessica Tinsley, attended as part of a 20-member group drawn from a diverse cross-section of business, civil society, union and academic experts. 

 ACCI will continue to constructively engage with the government on this issue as the government’s response to the review into the operation of the Modern Slavery Act approaches.
