The Full Bench of the Fair Work Commission recently handed down a decision that may affect the shutdown provisions in 78 modern awards. The decision proposes to amend the shutdown provisions in those awards by introducing a model term that will prevent employers from being able to direct employees to take a period of unpaid leave during a shutdown. ACCI intends to make a joint submission alongside other parties in response to the draft determinations published following the decision. The draft submission has been circulated to members. Members interested in being co-submitters are encouraged to advise as soon as possible. [Simon Farrow]
